J&J/DePuy faces class action

Orthopedic device maker DePuy is the target of a class action lawsuit filed on behalf of recipients of the Johnson & Johnson subsidiary's ASR XL acetabular hip replacement system by Ohio law firm Burg Simpson Eldredge Hersh & Jardine. DePuy recalled the device in August due to elevated rates of revision surgeries to replace the devices (1"The Gray Sheet" Aug. 30, 2010). Plaintiffs "are seeking answers to a number of questions, including whether DePuy should have known of the defects in the device prior to its sale and implant in patients, and whether DePuy failed to provide timely and adequate post-market warnings of the health risks," the law firm states
