The US Patent and Trademark Office has upheld the patent claims of Everest Medical over its bipolar cutting forceps. The move comes after a re-examination was requested by the company, following a discovery of prior art. There was much at stake for the company as it derives around a third of its revenues from the product. Of the patent claims, 21 of 23 were upheld; the two which were rejected had not been incorporated into the commercial device.
