Executive Summary

Sims Portex won a significant battle in its patent dispute with Vital Signs this month when the US Appeals Court overturned a District Court decision invalidating SIMS' resuscitator patent. An Illinois District Court has found that Vital Signs' Code Blue, Mouth-to-Mask, and Vital Blue resuscitators did not infringe SIMS' patent because the patent was obvious and therefore invalid. The District Court will now have to reconsider the alleged infringement in the light of the higher court's ruling.
