Executive Summary

Inamed's patent and royalty dispute with Dr Lubomyr Kuzmak and Ethicon Endo-Surgery over the Lap-Band obesity product is moving to the pre-trial discovery phase. The move comes after the US District Court for the Central District of California ruled that an agreement dating from January 2000 - which Inamed believed settled the dispute - was unenforceable. The dispute will now centre on issues of non-infringement, invalidity and unenforceability of the Kuzmak patents, as well as Dr Kuzmak's claim for royalties, the Santa Barbara, California company says.
