Cholestech fails to avert costly legal battle with Roche

Executive Summary

Roche has served Hayward, California-based Cholestech, with a complaint that it has violated three of its US patents for measuring HDL cholesterol. Although the complaint had been filed in the US District Court of Southern Indiana in March 2003, Roche had held back from serving Cholestech with it while the two companies attempted to negotiate an out-of-court settlement. These talks - which Roche said were aimed at granting a licence to Cholestech - failed.
