Zoll lawsuit brings “aggressive” response from Alsius

Temperature management specialist Alsius has said it will “respond aggressively” to a patent infringement lawsuit brought against it by resuscitation technology company Zoll Medical. According to Alsius, the lawsuit claims it has infringed two temperature management patents that Zoll (Chelmsford, Massachusetts) acquired from an unnamed company that was a former rival of Alsius’ and is now defunct. However, Alsius said that Zoll’s patents are invalid and that it retains a dominant patent position in intravascular cooling that “precludes any competitor from marketing an intravascular cooling catheter for therapeutic hypothermia in patients who have had cardiac arrest or heart attack”. The Irvine, California-based firm also said that Zoll has not yet sold any products based on the two patents.
