Executive Summary
Johnson & Johnson's Cordis unit plans to appeal a Jan. 20 ruling in Delaware federal court that found four of its drug-eluting stent patents to be invalid. The so-called Wright/Falotico patents relate to drug and polymer coatings for stents and are at issue in a 2007 suit brought by J&J/Cordis claiming infringement by Boston Scientific's Promus everolimus-eluting stent system. J&J notes that the ruling "is not expected to have any effect on Cordis' other litigation against the Promus product based on its Morris, Llanos and Fischell patent families." Last fall, Boston Scientific settled 14 other stent patent suits with J&J by paying $716 million.
