Executive Summary
American College of Cardiology wins expedited hearing set for Jan. 13 in U.S. District Court after filing a complaint Dec. 28, 2009, alleging that HHS Secretary Kathleen Sebelius unlawfully adopted new cardiology payment rates in the 2010 Medicare Physician Fee Schedule. The complaint states that using invalid Physician Practice Information Survey data would threaten access to care for patients and increase medical costs (1"The Gray Sheet" Nov. 9, 2009). ACC is also seeking help from Congress in stopping the payment cuts to cardiologists' offices (2"The Gray Sheet" Dec. 14, 2009)
