Executive Summary
Maryland federal court grants Igen International summary judgment against Roche Diagnostics GmbH on one of 14 claims filed in September 1997 asserting that Roche breached its licensing agreement with Igen by leveling unsubstantiated "rent" deductions against reported sales of royalty-bearing products. Ruling follows court's Jan. 29 and March 26 dismissals of Roche counterclaims of fraud and tortious interference. The licensing agreement gave Roche access to Igen's Origen technology for its Elecsys line of immunoassay analyzers and reagents. The 13 remaining counts, including other breaches of the agreement, unfair competition, and violation of good faith and fair dealing, will be presented at a jury trial scheduled for October
