MEDICARE PRIVATE CONTRACTS REG COULD IMPAIR ACCESS TO SOME DIAGNOSTIC TESTS, the United Seniors Association contends in a Dec. 30 lawsuit filed against HHS in the Washington, D.C. federal district court. Effective Jan. 1, Section 4507 of the Balanced Budget Act of 1997 requires that doctors who wish to contract privately with Medicare beneficiaries for services covered by Medicare to opt out of the Medicare program for two years. The conservative seniors group is seeking an injunction to freeze the implementation of Section 4507.
