Executive Summary

Settles lawsuit brought against the company by PPG Industries in August 1993 regarding alleged patent infringement and misappropriation of PPG trade secrets in the development of Diametrics" IRMA portable blood gas analyzer ("The Gray Sheet" Aug. 16, 1993, p. 29). Under the terms of the settlement, the parties agree "to dismiss all claims" against each other and "to grant each other full releases." In addition, Saint Paul, Minnesota-based Diametrics secures the "undisputed right" to practice its IRMA technology, "including the exclusive rights to, and full ownership of," its patented "gas battery" approach to the calibration of blood gas sensors. Diametrics expects to proceed with commercial sales of the blood gas analyzer "immediately"
