WL Gore & Associates Inc. lost a significant battle in a long patent dispute against CR Bard Inc. when the Supreme Court denied Gore’s petition for certiorari on Jan. 14. The decision leaves intact a June 2012 federal appeals court ruling affirming that Gore infringed Bard patent (‘135) for prosthetic vascular grafts made of highly expanded polytetrafluoroethylene and owes $681 million in damages, plus ongoing royalties for any future infringing sales. Gore is seeking a new trial at the U.S. District Court, District of Arizona, while Bard is asking a judge to collect more than $740 million in the case.
