C.R. Bard Pays $48 Million To Settle Brachytherapy False Claims Act Allegations

The settlement addresses allegations by the Justice Department that the company provided kickbacks to Medicare customers and physicians from 1998 to 2006 to purchase brachytherapy seeds used to treat prostate cancer.

The Department of Justice May 13 announced the settlement of a case with CR Bard Inc. for submitting false claims under Medicare for violations of the Anti-Kickback Statute, in which DOJ alleged that Bard provided illegal grants, conference fees and free medical equipment to customers and providers who used their brachytherapy seeds to perform prostate cancer treatment.

CR Bard must pay the government $48.26 million to settle anti-kickback charges under the False Claims Act, the Department of Justice said May 13.
