DePuy Loses Round One In First Product Liability Trial Involving ASR Metal-On-Metal Hip

A California Superior Court jury agreed with the plaintiff that DePuy's metal-on-metal hip was defective in design, and awarded him $8.3 million in damages. Plaintiff Loren Kransky was the first of 10,700 U.S. litigants slated to be heard in court.

DePuy Orthopaedics Inc. plans to appeal a March 8 jury verdict which found that the DePuyASR XL metal-on-metal hip replacement system was defectively designed, and that plaintiff Loren Kransky should receive more $8.3 million in damages for injuries suffered. Of that amount, $8 million was for physical pain and emotional suffering, and $338,136 was for medical expenses.

The jury rejected Kransky’s claims for punitive damages.
